Default Stuck between first day at office policies and indian passport renewal

I am on H1 visa and got an offer from new company who filed my H1 transfer. After submitting my visa papers to the new company I submitted my indian passport for renewal at SFO indian embassy on 4th June 2012 as it is to expire in mid july. I had informed the legal team/HR of the new firm about this.
Now on first day at work (18th June 2012) in new company they are asking to furnish original passport to start work. I resigned from my old firm 2 days before first day at new firm. Is driver's license(identity proof) and I-797(work authorization proof) not sufficient to join a new firm after they have filed for H1 transfer.
I have been running to indian consulate and 06/22/2012 they told me my passport was processed on 13th June 2012 and they are not able to trace where it is. What can be done now...in case it is lost how do I produce a passport to new employer to join? Is there a service for tatkal/same day passport. Has anyone got same day passport in case of emergencies?

Ksri,

Not sure why they want to see your old passport. But maybe this will help. They have the complete Form i-9 section 2 within 3 business days from Hire.

As part of the employment verification under Form I-9, they require a document that shows proof of eligibility to work in the US. The Passport is one form of identification under List A document.

You can also submit submit an Driver license and SSN from List B and List C in lieu of the passport.

If you and your new firm are still waiting for H1 B transfer - you canuse the I-9 receipt rule and you have 90 days to produce the required documents if any of the other documents are not available.

Also if your new employer subscribes to E-verify, they do not need to do E-verify till you get expiry of the receipt
