My H1 B was filed in 2008 april , it got aproved in june 2008 in this time i was in india , I have got my approval notice also. But due to recession i did not get any job that time.
Now i am in USA on L1 visa and wants to change the status to H1. pls advise can i use the same approval notice or do i have to come in this year quota and file fresh. |

Hi,
I am in a situation. I came to US last year on H1b of Company A. This year on 30th Nov 2012 Company B applied for my H1b transfer which was approved on 5th December 2012 but Company B never gave me Receipt Number or sent my Approved I797 copy. I am still working for Company A. On December 21st Company C applied for my H1b transfer but they have my Company A's I797 Approved copy not the latest one from Company B's which they never gave to me. Is it a Problem? Do I go ahead and tell Company C that I have one more H1b transfer approved from Company B which I never joined and neither do I have the receipt number nor I797 copy. Please advice. Thanks. Hi Gurus,
At time of H1b transfer one of my friend edit degree certificates and marksheet and changed the years. His H1B transfer approved and no RFE came. Now he is planning to start GR process. now he realized that he did fraud and instead of giving original date he gave wrong date and even modify scan copy of all education documents. Now how he can solve this ????? what he need to do ??? Note: At time of H1B apply he submitted correct dates and original scan copy of all document. |

Hello everyone,
I need help with H1B transfer question and would appreciate your help. My scenario: 1) Worked with Company A on H1b from 1st Oct, 2009 to 14th Oct, 2011. During this time also got I-140 approved with a PD of Oct 2010. 2) Moved to Company B. H1b approval is until 2nd Oct, 2014. Company B is about to file PERM. 3) Looking to move to Company C somewhere in March 2013. When Company C will apply for H1b, what would be the H1b expiry date ? I am not sure how this works since my 6 years on H1b will end on 30th Sep, 2015. I do have an approved I-140 but it is with Company A (they have not revoked the I-140). I am confused if the H1b will be until 30th Sep 2015 (based on 6-yrs of H1b) or March 2016 (based on 3-years extension after an approved I-140). Thank you for your help. |

@ itsmeusa: thanks a lot for ur reply. The job is Full time in the energy sector so I am wondering how would they prove that my project/work will last 3 yrs. Anyways, I assume that they will be able to prove that.
Also, does it mean that I can keep getting 3 yr extensions forever based on Company A's approved I-140 ? Thanks again. |

If you can get a client letter stating that your services are needed for 3 years. Ask them to add one more line to put their mind to rest - This is just an intent and not a contractually binding statement.
Yes, you can get extensions based on approved I-140 from previous employer. However, if CIR happens and your PD becomes current, you would be able to file I-485 only if your employer A (who has I-140 approved petition) is ready to give you employment verification letter and there exists good intent on your part to join them on receiving green card. If this is not true in your case, you need to start green card process with your current employer. Best luck! |

Hi All,
I have landed to USA from India with my H1B Visa 3 weeks back. Now I am planning to apply for SSN. My problem is that in my I797B notice, I got my middle name misspelled. My Visa application I-129 has got the correct name while applying. This typo error in my I 797 is a made by mistake by USCIS guys. I have raised the amendment request through my company which will take atleast 2 months to get that corrected. My question is that shall I apply for SSN with my Passport (attached with I9 card)and Visa which has the correct name. Or I need to wait till my name gets amended in I797 B form. My company guys are saying me to wait till the name gets amended which i think is too long. Kindly guide me on how to handle this. |
