What if someone doesn't drive at all !! Does that mean they won't get an H1b visa or extension. It is simply not true I think.

Ask your lawyer why the driver's license is required? Passport is an accepted form of identification. Either your lawyer is ignorant(time to get a new lawyer?) - or he is taking you for a ride (he will milk you/ your employer for more money when extension time will come again).

Default Local DMV (NC state) denies DL without visa stamp!

Hi,

My wife is on H4 and she has her H4 extension approval. But the local DMV says that they need to see a visa stamp in her passport to issue a DL. Its actually exchanging her out of state DL! Can anyone from NC (Raleigh, Cary, RTP, Durham etc) share their experiences please.

This was introduced very recently and unfortunately they are asking for a VISA Stamp in Passport. Earlier they were not issuing the DL without an ITIN if you do not have SSN; my wife had to wait for almost a year as you cannot apply for ITIN unless you send the W7 with your tax returns due to new regulations. Now they are NOT concerned on ITIN, but are looking for VISA stamp. Only thing that can be done online in NC with regards to DL is you can get a Duplicate DL online if lost or your address is changed. Try writing to Congressman David Price and see if you can get assist from him. I know this office has helped folks here on Visas before for other issues.

As someone else pointed out, if you don't drive will he/ she won't get a H1B?

This does not make sense.

I just renewed my DL in and BMV did not even ask for my visa/ passport validity and they issued me 5 years renewal (my visa expires in Oct 2008).

I can understand that based on your visa expiry date, BMV may issue only limited time DL.

I know each state has jurisdiction on these matters but there should be basically similar approach.

I went to the VA DMV in Sterling yesterday and the person there refused to renew my DL based on my original H1B extension extension RECEIPT Notice, saying there is no 'Date' on this document. These ppl are too dumb. It says clearly on DMV's website - they will give you a 1 yr extension IF there is no date on that document. Need to take a lawyer and paralegal along next time...

BTW, how did you manage to do this??

I am travelling on the same boat too. I checked with one of the DMVs in VA and they were not ready to accept the H1 extn. receipt notice. I am planning to convert my application to processing.

Hi Virtual55,

I check with one of the DMVs in VA and they are not ready to accept the receipt notice, instead they very clearly are expecting a 797 approval notice.

Let me know if you have any advice to handle this situation.

Default DL renewal in Ohio after filing I-485

Folks,
Anyone having experience renewing DL in Ohio after filing for I-485? Do they issue DL for 4 yrs? Or do we need to apply for EAD (if H1B is expiring and company is not willing to apply for H1 extension) and DL will be issued till the expiry of EAD?

My wife's DL expired in June 2007. We got her extension in April 2007 for next 3 years. FYI: It took only 40 days to get the approval. Applied in PP.

We noticed the incorrect DOB in her approval notice. Attorney contacted CIS about this. We got a letter from CIS asking us to wait for 30 days to review her case. It is 90+ days since we reported CIS's typographical error. They took 40 days to approve the extension but they are taking more than 90 days to correct the DOB and issue a copy. Congrats CIS!.

Because of CIS's typographical error, we are facing hell of problems. She couldn't renew her DL. We went to DL office. We were asked to file a complaint. That takes ANOTHER 10 to 12 months to get the feedback from DL office.

I don't know what to do other than just WAIT!.
