I live in Georgia and I agree with you all. All these DMVs were sleeping and woke up after 9/11 and imposing these strict rules that makes everyone's life miserable. Unless you live in a city life will be hell without DL and we are sweating it over every time a renewal comes up. How am I suppose to explain DMV guy about I-94, H1 extension etc. Even some immigration officers in airport give wrong I-94 expiry date without understanding the difference between visa stamp and extension.

Hello, could you please give some info?
Should my spouse, going to live in CA in H4 status, get US driving licence, or DL issued abroad of US will be enough?
One more question. In how many days after entering US (California) in H1B status, should I apply for US DL? The only defined preiod I found on DMV site, is 10 days. But how can I proof my address of residence in US after only 10 days?

My drivers LC is completely linked to my H1 status. Twice I got DL only for 14 months and had to extend it again the following year. Generally they extend your DL 2 -3 months more of the expiration of your H1B.

DMV California doesn't need proof of residence....it will ask for I-94 or Greencard to check your legal status....as for residence, it will only ask for your address and will not ask for any proof...

Expiry of DL from Ca. DMV is based on I-94....

Luckily this week I got the H1 extended and today I carried the original approved H1 I-797A and got the DL extended. I got only 2 years H1/DL extension after 6 year completion with I-140 approved and 485 in progress. Fyi

My DL expring in Sept. filed for 10th year extenison, I live in NY.
NY DL have 2 dates, One in Top with RED Bold letters its called Temp Visa Date and at botton DL exprie date. I have contacted in DMV office. They said I can drive using bottom Exprie date which is exprie in 2010(mine) ,But I cant use the DL as ID if Temp VISA expire on DL.Unless I renew it with approved H1B visa date.So I have to Carry Passport ,recepit copy and Employer lettter with all time just as proof if cop caught me.

Can we use the I-485 receipt notice for extension of DL for my wife. She was on H4 which expires Oct 20. She plans to use the EAD card to work and we will not extend her H4 unless EAD does not come before Oct 20. She got a letter from DMV yesterday asking for additional proof for extended stay. Also will EAD suffice as evidence?

I have filed I-129 and I-539 at VSC (RD 7/16/07) and also concurrently file I-140 + 485 at NSC on 7/2/07 (No Checks cashed yet). My H1 and spouse's H4 expires on 9/30/07. And so does our DL.

I called the PA DoT and they said that they need the following documentation for the DL renewal:

H1B & H4 Visa
Passport
I-94
Visa
Proof of employment (For H1 only)
2 Proofs of residency (For H1 only)
Rejection letter from SS Office (for H4 only)

They will not accept a Receipt Notice. They also said that if the Visa wasn’t valid for more than a year, they will not renew DL. I don’t know if they will accept a Visa stamp on the passport or approval of I-129 & I-539 will suffice.

From your experience, at this time, if we apply for PP, will they process my spouse's application along with mine, so both approvals come around the same time? Please advise.

My wife is on H4, i'm on H1B. She applied for DL renewal and was renewed for 1 yr.
They accepted visa, passport, i-94, and H4 renewal receipt notice.
They gave her one year from receipt notice.
What a relief. i was worried they would not accept it.
That was in Sterling VA DMV.

I live in colorado...my H1B is going to expire Oct 27...I have not applied for H1B Extn. yet...But i have EAD...According to colorado DMV i should be able to use EAD for driving license extn...but does using EAD invalidates my H1B??...i am planning to apply for my H1B extn this week...but i won't be able to get approval in 3 weeks (assuming i do premium processing)...Please help me.

I am not understanding if sending DL is an issue or your concern is just over why USCIS is even asking for it?? USCIS does lot of things in unexpected way.. so I won't be surprised...

Presenting your EAD to DMV for verification does not invalidate your H1B status. Only when you present it to your employer and if he fills out form I-9 and if USCIS requests verification of employment then you will need to worry about that.

The only issue I see is license with 1 year validity... Still better than none :-)

EAD comes in pictiure only when you use it to work... for immigration purposes..
