Regarding H1-B Transfer

Hi All,

I need some Input.

Actually I worked for some X employer till Sep 15th, later I got a full time and moved to a different employer Y.

My current H1 visa and I 797 with employer X get expires this month end, so before I got full time opportunity with employer Y, my H1 renewal has

been applied and receipt number was available.

Later when i moved to Employer Y they collected my documents and got LCA clearance before submitting my H1 transfer.

Meanwhile they gave me my paychek which i deposited into my bank account. Is that Okay.

because my H1 hasn't transferred or applied with employer Y by that time.


Do I need to do anything in order NOT TO HAVE any issues in future.

Did they filed your H1 Transfer petition prior to running your payroll?

If you have your recept number prior to your payroll, you should be good.

No they haven't filed H1 prior to pay-roll...they will do it today or tomorrow

I used to work for Company A. My labor and 140 were approved from this Company A. I - 485 is also applied from Company A on July 2 and now I had moved to Company B three months back and instead of moving on EAD I transfered my H1 to Company B. At present Comapny B holds my H1 and I even got transfer approval notice last month. I also applied AC21 stating that I am with Company B to USCIS.

Now, my question is do I need to apply I - 140 again with Comany B or it's not necessary. Will my 485 case gets effected in any sense, since it's filed by company A and right now I am with Company B.

I need to know the answers ASAP as my dates are current and I want to know my options.

There is no need to file the I140 with the new company. You can carry forward all your GC processing to the new company. As you also filed AC21 no worries. As your dates are cuurent, just try to call the customre service and enquire about your status.

If you submitted your EAD along with the other documents to your new employer, they might have run payroll that.

For your new employer to offer you a employment and eventually run the payroll, they either need to have your H1 transferred to their company (receipt would also do fine) or EAD.

As you said they didn't filed your H1 transfer prior to payroll, they might have used your EAD.
