I think it is very clear from some of the replies that you can continue to get 3 year extensions with an approved 140. Please post what you finally get. Sometimes attorneys can be "illiterate". That is the good thing about forums like this where we get some idea about the laws ourselves.

Default 3 year H1 extension filing fee

What is the USCIS filing fee for a 3 year H1 extension.

Is the filing process complex ? I am thinking of self-filing.

I am contemplating filing this instead of AP every year.

Any advise is appreciated.

How can you self file a H-1 petition. You employer is supposed to do that on your behalf. Beneficiary cannot file it.

I understand they have to sign the paperwork. Instead of the lawyer collecting the paperwork, I thought I'll do that as my company does not want to spend too much attorney fees.

Default How about spouse

Guys,
My wife is on a seperate H1 with a different employer. I have added her as my dependent in my I-140 petition. Can she also get a 3 year extension based on my approved I-140? Or she is out of luck after her 6th year?

Thanks for your response.

Your spouse cannot be a part of your I140 petition. She will be a part of your I485 petition. So she cannot get an extension in H1 based on your I140 approval.

I finished my 6 years of H1B in 2006. At that time, my wife's I140 was approved but our 485 wasn't filed. So I had no option but to sit out of work till I got my EAD, once our I485 got filed. Unfortunately, I didn't have an independent GC in process at that time.
I hope you don't have to face this scenario.

Just send a copy of 140 along with the package and request for 3 years in the covering letter and in the form.
