How should I get a custody for my step son?

I got married recently and now I'm in US. I'm planning to bring my wife and my step son to US very soon. When I called the embassy, they said, we should carry some document stating that my wife should have son's custody. This statement has not been explicitly mentioned in the divorce notice.

So now what should I do?

Your response is greatly appreciated.

Note: I'm on L1B VISA
