Legal Proceeding Notice from previous employer

Hi,

Can anyone let me know how to deal with the below situation

I have been employee of a desi consultancy for past 1 yr and now my end client made me permanent.Now the desi consultant sent me legal notice that they want 3000$ for visa expenses and also they say "you should not join our client based on non-solicitation clause in agreement, that you signed with us. Also we suspect the experience you showed in resume is not real."

first of all the end client is not there client as there was a mid vendor and they have client relationship only with the mid vendor and I am hired by end client and not the mid vendor

Second they put some serious allegations on me which are false .Till now when i was earnign for them they never had such issues

Seeking advice on how to proceed on this one

My friend went through the same situation few years back. She was sent a notice to which she responded on phone and email that she will be more inclined to meet them at the court and also reveal what all she knew about the company (like all the false promises made about insurance, continued pay etc.). After that, she was never bothered.

I understand that your ex-employer is trying to retain you for an extended period and using empty threats. As for allegations/whatever those are concerned, you shouldn't worry as they haven't questioned their validity until and after you have decided to leave them.

In short, tell them to **** off and they will do that.

Remember this is all crap!!! Let him know that you will report to DOL and let them know malpractices they do.....also tell him that they pay you 1 month delayed payments which is unlawful by law delaying payments.
If they pay you per diem without any expense receipts than tell him that you will go to IRS also and complaint there too.........

Only this much is more than enough for him to stay quiet for life!!! This desi consulant companies are cheap guys and unprofessional completely.

Most of us have been thru this!!! for just $3000 + some other things..... he wont go thru legal proceedings since its a big mess for him to pay the attorney and all that.......and $3000 is not enough to pay the lawyer only..... :-D

Moreover Visa cost has to be taken care by the employer and not by the employee....this includes the flight charges you incur when travelling from india to usa for the job....
