Hi
I have a question, because I was working with a lawyer and he give me my Labor Condition Application certified but I had to change lawyers and right now I have that LCA certified but i dont now if i can use it yet, it has a expiration date that is 01-31-2012 but I dont now if the salary is correct or it can change. Please let me know my H1b expires 08-31-2011 |

Hi,
I am in India and just got my first H1B approval which is valid till April 2013. I shall be coming to US in April this year. Please let me know the process for H1B extension. Does it depend on the annual cap that is there on H1? What if it gets full? When and how can I apply for the extension? Any info that you guys can provide would be great. Thanks for help. |

Once H1B is approved then it is not subject to any quotas for renewals. Your company will have to file for your extension at least 4 months before the expiry date (I would recommend 6 months) as sometimes USCIS takes longer now days. Unless you want to file for Premium Processing which would cost you/your company approx $1200 extra. Your company attorney would file for your extension with the USCIS, so this should not be of any concern for you now.

Hello,
I am new to these forums so i apologies if this is not the right thread for this sort of discussion. Here is the situation Visa Valid till : April 3, 2013 I-94 Valid till: April 3, 2013 My employer is already starting the H1B Extension process using regular processing. Here are the questions i have: 1. In case visa extension is denied well before my I94 expires, can i stay in US till april 3, 2013? or do i have leave country immediately upon denial of extension? 2. In case extension is denied, what are my options? provided i have time left in my I-94 expiry? Visa transfer? Repeal of extension? Any help would be appreciated. Thanks a lot. Regards. |

Company A file my GC (EB3) in May 2007 and I got EAD, curretly working on save EAD.
then Company B convert EB3 to EB2 in 2012. Labor Approve and I-140 Approved in January 2013. but now my Company B is started giving me hard time. I will be greatefull, if any body can answer these question. 1. Is it safe to leave company B and start working on Company C.? 2. Is Company B revoked I-140, does it has any effect in my EB3 to eB2 Conversion. Thanks Deepak Kumar |
