Arrow Got Green Card when on vacation...

Hi
My spouse on vacation, while she is with her parents we received our GC. Now question is she went out on Parole and can she come back on parole? I have scanned and sent copies to her but not sure whatz the procedure. Any information highly appreciate.

Your PD shows as EB3-04, did you convert it to EB2 ?

Yes, she can re-enter using AP. Do not try to enter using any other non-immigrant visa as it could lead to complications.

What if there is no AP. Can the dependents come back on H4 if the GC is approved when out of country?
If the dependent is out of country and just the primary received GC how can the dependent come back

Can anyone please answer

I think I read something about deferred inspection in these cases. They let you in with imigrant visa stamp.

This would hold true for people who were not aware their GC was aproved before they reenterd the country.

Search the forum and web. I think there was even a memo or QA on uscis website in the last couple of years regarding this. The same QA where they talked about H1/L1 and GC issues etc.

thanks for replies, I spoke with Attorney and she said, keep the approval emails from USCIS. Those emails have to show when asked by officer.

To answer RB, yes back in Dec 2007 I filed for porting and it was denied. While I was in Africa tour back Aug 2009, they touched it. And it seems like they ported my case and approved gc on 09/ 9 / 2009. Next day after return I got approval mail.

I do not how true it is, it happened with me and brother too, when 485 pending we traveled on AP and got the GC.
EB3 Jul 2004
EB2 Nov 2006. Both are belongs to same employer.
