Default Marriage Proof?

Hello,

My friend strongly recommended this forum to me and here I am.

My husband submitted his I-485(EB2) in 2007 and we got married 2/2010.

My husband's PD will become current on 10/1 and we plan to file mine as dependent. The lady from his attorney's office suggested us, along with my i-485 application, provide marriage proof documents such as pictures, letters from friends, etc. She said that was to play safe as our marriage is shorter than 2yrs.

We heard about that 2yrs thing but it was for those married with US citizens but didn't know it also applies to EB applicants. We believe we are not the only two married after filing I-485. Could someone please confirm this? If this is necessary, what should be submit other than joint banking account statement and phone bill?

Default Marriage Pics

Marriage Pics and the Invitation Card for your marriage should also suffice.
There are some other methods like showing phone calls made to each other, lease agreements or any legal contract with both your names on it (Utility Bill, Phone Bill, Bank statements etc)

Marriage certificate is good enough. Don’t send your pictures or other documents unless USCIS requested. Why need to think in other direction…?

If I were in similar situation like your husband, I will add my spouse name in my passport and also request to add my name in my spouse passport. This is more stronger than pictures or invitation.

If you haven’t done this yet…Please go to the nearest Indian consulate and get this done. If you guys already have your names in your passports vice versa, This is more than enough for filling I-485 as dependent. Good luck.

Post Marriage related RFE...

My brother got married just a month before filing I485 and received an RFE requesting evidence of proof of marriage. Based on his company lawyer recommendation (who he had a very high opinion of), they submitted the following documents, and did in fact receive their GC soon after responding to the RFE.

Here is what they submitted:
a. Joint Tax Return
b. Letter from Primary Applicant’s employer which confirms Ms. XXX is beneficiary of Primary Applicant’s employee life insurance
c. Proof of Joint bank accounts
d. Apartment Lease Contract
e. Marriage certificate

As many of the above as are applicable to you are strongly recommended to be submitted.

In addition, you could submit some joint vacation pics, medical insurance cards, ... The emphasis has to be on showing that the marriage is bonafide and still valid ....
