It is possible. You can read the instructions document relating to I 131 form. You may have to file additional documents. These instruction documents available in USCIS website under forms menu.

My attorney had mentioned some months back that this is possible and he has done this successfully for one of his clients whose spouse was in Europe when the AP application was made and approved - they just mailed the AP document to her and she came in with no issues.
Though the application form explicitly says that one cannot apply for Ap when out of the country unless you are going to have it mailed to the local consulate in that country and submit additional documents... my attorney said that this information was not accurate anymore and he had successfully applied for AP for folks who were not present in the country during the time of the application or approval. Again this is not a personal experience but something I thought I'd share - not to make it any more confusing than it already is. I would be very interested in finding out more about this as well. |

I had seen this info on one of the older threads on IV as well - you would need a good reason to justify an emergency though (marriage in the family, vacation, etc won't suffice).
From what I remember someone here had mentioned that you could get an AP within a day or two (if not the same day) via an infopass appt for a real justified emergency. Quote:

It needs to be obtained before your travel and one should return before it expires. Traveling first and then applying for permission to travel beats the intent. Just for your information, I applied for AP for my family and myself (4 of us) about 2 weeks ago and we got the original approved AP within 10 days from time that USCIS (Nebraska) received our application. So I believe that this is really quick and one should have this as a backup. I have a current work visa valid till next year but applied for AP just as a backup for our trip to Asia this coming summer.

I applied via snail mail to TSC in the last week of March and got the approved documents in mail by 2nd week of April.

the instructions to apply for advance parole asks for "a copy of any document issues by USCIS showing present status in the US"
since I am no longer on H-1B (I left my sponsoring employer last year) and I have been working with a different employer on EAD, what document should I send to show my present status?? by the way, I have a pending I-485 Thank you in advance. |
