Default EAD or H1B1

Folks,

My friend has a question whether he should activate his EAD or should continue on H1B1. I remember reading some information regarding this on some thread, however, I can't find that anymore.

Labor is approved.
I-140 - filed, however it's PENDING.
I-485 - filed - concurrently.
EAD - Approval Received.

any feedback will be appreciated.

Thanks,
pan123

Pan123: Considering your friend's 140 is pending. I would recommend him to continue with his H1B status at least until the 140 is approved. If the personal circumstances forces him to use EAD, it would be ideal to consult an attorney before making a decision.

There is very little debate on this
if you donthave 140 approved- usin EAD is very risky
Unapproved 140 can be withdrawn by the employer at any point and if 140 dies- the whole GC application crashes like a house of cards
