Today I received my and my wife's EAD card but USCIS has swapped the PHOTOs on both the EAD. Now I have only 4 weeks left on my existing EAD card. What should I do?

I called customer service and generated a case. Customer servicse said wait 15 days and you will get to know the next step through postal mail.

Can infopass or congressman help in this?

If USCIS asks me to refile application then will it be a new EAD application? In this case I have to loose my job as new process will not be able to provide EAD in 4 weeks.

Will new EAD card have the same dates as the wrong EAD cards have?

Should I e-file a new application without waiting a letter in 15 days from USCIS?



Please suggest me based on your experience.

I was looking the forum and people are suggesting to send the following:

1) write a Letter to USCIS explaining the problem
2) Wrong EAD Card
3) New photos
4) New I765 application without fees
5) Passport photocopies


Should I send these documents now or should I wait to receive a letter from USCIS (within 15 days)? Do we need to include the letter that we are going to receive in postal mail in next 15 days with these document? Please HELP....

Can someone help please? Will there be same dates on the new corrected EAD as we have on wrong EAD? I have kept photcopy of each paper that I sent to USCIS and I have written name and A# back of the photos too.....

Can someone please share some experience (my issue is mentioned just above of this message)?

I maybe wrong, but I feel that your new EAD card is technically valid. You may show your employer the "Name" on the card, as well as the mailer which comes with it. Also show the EAD receipt etc. Explain the employer that the photos were swapped - shoeing your wife's photos and they you have already talked to USCIS and the steps you are taking.

Thanks your reply but I think it is not only something whether employer will allow or not but first thing is whether am I allowed or not? Allowing from employer is essential but if I try to convince them, will it be a problem for me in future from USCIS side if the replaced cards do not have same dates as the wrong one? Lot of disappointments here and no one cares

Has anyone faced this type of thing recently? Can you please suggest the process and whether replacement card has everything same other than the things which will be corrected?

Photos on my EAD card and my wife's EAD card have been swapped by USCIS. I am sending them a new form to correct the problem. Can you please suggest in the point 11 of I-765 which EAD card information should I provide? Point 11 ask you whether you have applied EAD card before and which center/ Date/ Status etc....should I fill the details accotding to the EAD that has incorrect photo or should I fill the information in point 11 based on the previous EAD (which is still valid from 2010 to 2012)?

We had same issue for AP last time, they switched the photos of mine and wife. We took the infopass and they issued the AP for me and my wife same day at local center. I'm not sure local center can issue the EAD though. since this is the USCIS error, you don't need to pay fees again.

I am the primary applicant and am currently working on my the adjustment status. Last week TSC cashed my wife's AP and EAD checks but just my AP check. Earlier this week we also got the 3 receipt notices for those 3 applications. So far they have not cashed my EAD check.

Both our EADs expire in early October and our APs have expired for more than a year. We had put a cover letter asking for a 2-year EAD/AP combo card.

I am not sure what I should and could do as a next step. Would really appreciate advice.

What is INS RESIDUAL means?
Photos on our EAD cards swapped and service request reply asked us to send our original card back to NSC, PO BOX 87172, LINCOLN, NE-68501. USPS delivery confirmation says that package has been delivered to INS RESIDUAL in 68501. I have not seen any update on my application in last 10 days. Any suggestion on this please? Has my application delivered at right place? I hope USPS delivered it to the right office (PO BOX)? I tried to search on google but it was not helpful.

my EAD is expiring in September end (less than 120 days) and my AP is expiring in December (more than 120 days) .

Can I apply using the concurrent filing or I have to apply EAD now and wait for AP until it is less than 120 days.

Anyone have similar experience please share.

Q7. What if I already have an EAD or an Advance Parole document?
A7. If your Advance Parole document and EAD card have different expiration dates, you may only receive this card if both documents have less than 120 days of validity left, or if the EAD has less than 120 days of validity left and the Advance Parole document is for a single entry only. If you decide to file for this card by filing Forms I-765 and I-131 simultaneously, do not apply more than 120 days before your current EAD expires. The validity period for the EAD and Advance Parole card will begin on the date of the adjudication of the Forms I-765 and I-131.
