Default Re-entry with new employer

Hello! I will be travelling to Europe with family in couple weeks (June 19th - July 19th) on Advance Parole. I recently got a new job offer that I have accepted from July 30th. I am in two minds when to let my current employer know. If I do on return, it gives them just 1 week and that may not be enough since I have been with the company for 9 years. So I was contemplating of doing it soon (before I leave) so that it fullfills a 2 week notice (work hour wise). My only fear is I may get questioned on AP, and if they will reach out to my current employer. And basically how it will proceed from there on. I can of course take offer letter of my future employer but cannot expect much further assistance since I haven't even started.

So any votes one way or another would be helpful. Thank you!

It is very unlikely that at the POE they have time for such detail checking as to calling the new employer. I think the job letter offer should be fine,along with last paystub of old employer if you can get it online. This is just my opinion. Good luck and let us know how it went.

When you re-enter using AP, there is always a secondary immigration check after the regular immigration check. You will be asked to go into the immigration office and will be asked to wait till your background check is complete. At this point the IO will verify weather you have a valid status, he/she will check if you ever overstayed which will make you illegal(standard process of Parole). I read in this forums that sometimes the IO will ask you to produce all the approved H1 petitions to verify your status. If you have a valid EAD you should be fine. But do carry all your approved H/L petitions from the past along with your EAD. Also carry your offer letter from new employer with you. You will be fine as you will still be employed with your old employer. Employment Termination will occur on your last working day at 11:59 pm so when the IO contacts the employer (very highly unlikely situation) they have tell the IO that you are still employed with them.

First time when I entered using AP it took about 3 hrs for the whole process to complete. So take a good book for reading while you wait for your turn. Good Luck!
