Default AC21 with same employer, another state/job location

Hi,

My PD is Sep 04 EB2(non IT). I have been working for my empoyer since 2004. I just filed I-485. My employer has offices/job locations in other states too.I would like to move to another state permanantly and work there(for the same employer in the same position).
My question is can I invoke AC 21(after 180 days) in this case and permanently move to that office/state and not come back to work at current/original location after AOs is approved?

OR since I will be working for the same employer I cannot invoke AC 21 and will have to move back and work at the original location for atleast some time after the AOS is approved.

AC21 is geographic location indifferent. If you work for the same company I do not see why you should have to invoke AC21!

Default My friend moved to from where his Labor was filed

Since GC is for future job.. labor can be filed from any state... My friend worked for a company with office in 2 states.. For some reason his labor was filed from other state... His company attorney asked him to move to this new state after getting EAD.. So that there's no issue with his GC process...

You are going to do it other way.. Please check with your lawyer... But personally I don't see any reason why not.. Again I am not a lawyer... My 2 cents only...

Is it allowed to work on EAD with the same H1 Employer ? Is there any time
frame for this. and also if it is the same position can the salary be more with the same h1 employer.

Default Change of Location

Hi,


My company is located in X state. Currently I am working in Client place i.e in Y state (staying from Feb to Aug) but my H1B LCA is showing X state.

My labor and I140 got approved in X state address.

During this 6 month stay in Y state, I applied I485 for me and my wife by showing Y state address through my same employer.


Could you Pls clarify, wheather this new address will make any impact on my
I485 filing.
