From IV : Did USCIS deny Your 485 when 140 was revoked after 180 days of filing 485?

We have been seeing and experiencing this issue where USCIS issues denial on 485 when the beneficiary changes jobs after 180 days after filing 485 and when the petitioning employer requests to revoke the i 140 petition.

The i 140 petition is a company owned petition and the beneficiary has no control over it, however if the beneficiary changes jobs after 180 days of filing 485, the beneficiary must be able to adjust status irrespective of whatever happens to the i 140 as long as the beneficiary can prove that he/she is in a same or similar job.

Immigration Voice is willing to help people with this kind of issue. We want to collect information from everyone who are experiencing this issue and will be taking this issue to appropriate authorities.

We have seen so many threads in the past on very same issue. Guys come forward and setp up the effort to get the training issues at USCIS fixed.

We need real cases that can be presented. So - it is our request to the community to come forward and contact IV.

Good Initiative by IV. I am not in the similar position, but i had been waiting for my I-140 Amendment to get cleared from Aug 07 fiasco. Right now i am still with the same company, but if something has to happen I would need help related to that. I believe i need to file MTR.

Please post this on all immigration websites and keep the thread on the top so that you can collect all folks in this situation. We can try to fix this problem once for all so that all current and future users of AC21 do not face denials of their applications.

Last time, when we started this campaign, a bunch of people sent me their information regarding denial of 485 due to 140 revocation. can these guys come forward and let us know the status on their 485?

As per my understanding - those people have already got their MOTICs resolved and cases reopened.

But lets see if their cases history helps us. Please have them send their case history to me.

We must build a strong case to show that this is a pattern.

I commend Chanduv23 for taking upon this initiative.

This is a blessing for people that are in this predicament due to wrongful 485 denials.

I hope this motivates more people to contribute financially, this type of work often involves financial costs in addition to the volunteers' personal time and energy.
