Default Previous Employer not providing document required in RFE

My previous employer is not providing the document required in RFE in fact of format request.

Is there any way we can get the documents from previous employer (desi)

Hi,

Recently I transfered my H1 B from X company to Y company & now I am going for my visa renewal. My previous employer is not providing me the experience letter. Though I am having all my paystubs, appointment letter etc. I think I need the experience letter also...So what should I do now. Please suggest me.

You shouldn't need an experience letter to apply for a H-1B visa, especially when the visa is for a different company. Eligibility for H-1B status doesn't depend on experience, it is education that is important.

Exclamation Ex-colleagues are afraid to write experience letter

I am in similar situation but in GC process. My ex-colleagues are afraid to write experience letter for me.

Some colleagues who are still working in the same company doesn't want the company to know about the letter. They are afraid that company would take action if USCIS contacts the company to verify the letter.

Some colleagues who are out of the company are concerned about USCIS process. Basically they don't want to involve in any queries/RFEs from USCIS.

Experience letter is always useful for H1B and Green Card purposes. Try to take an affidavit from your supervisor(ideal) or colleague listing the duration and technologies involved.

Sangeetha:

USCIS does want to see that you worked for your prior H-1B employers, but USCIS is happy to accept recent paystubs to show this.

It doesn't hurt to submit experience letters, but as explained before, you do not need experience letters for H-1Bs.

Cool..Thanks for all the responses.

I was just preparing for the wrost case scenario. So thought to get the experience letter of my prior H1B. But right now, I am unable to get hold of any superivisor or co-worker. So is there any other option to get the experience letter.

Dear Sangeetha,
For H1B you may not need exp letter.
However for I140, you will and you can get experience letter from Ex-Colleagues or Ex-Manager. It worked for me.

Get it from your lawyer. That is what I did.
They know what language would be appropriate for your case.

Where are you reading this? As I mentioned, an experience letter should not be needed for a H-1B visa application.
