Finally, the decisive victory for all sufferers stuck in name check! The USCIS issued a memorandum to change its policy regarding name checks. The completion of FBI name check is no longer required before application for adjustment of status can be adjudicated!!! If FBI name check is not completed in 180 days, I-485 can be approved without it.
http://immigrationportal.com/attachm...0&d=1202337346 Finally everyone's efforts are bearing fruits. It takes time to get results but we do get success in the end. Many people have worked on this namecheck issue. IV on its part has raised this issue with lawmakers and administration on several occasions. This is good news for I485 applicants and hope everyone values the efforts of this community who individually and collectively helped raise the profile of this issue. - IV team

Finally I found the text I was looking in this 11 paged document.. Where the application is otherwise approvable and the FBI name check request has been pending for more than 180 days, the adjudicator shall approve the 1-485,1-601,1-687, or 1-698 and proceed with card issuance. The FBI has committed to providing FBI name check results within this timeframe. There is no change in the requirement that FBI fingerprint check, IBIS check and FBI name check results be obtained and resolved prior to the adjudication of an Application for Naturalization (N-400). |

Too little too late.
This would've been really useful back in Jun/Jul when dates were current. Now with dates retrogressed, this is of absolutely no use. Think of it this way - it'll take five years for your PD to be current. Your namecheck would've cleared by then anyway. *&^%$ you USCIS. |

I don't think the executive branch will concede (as a general policy ) to anything that brings good to legal immigrants. Hope this happened last year. I applied I-485 in july 2006 and got stuck in name check. Now EB2 India "U" . Ha. Ha.
