Work Independently on EAD

Hi Friends,

My wife has recently got her EAD. My question is that whether she can work as a freelancer or independenty. Does she have to have her own company and then work?

Any help or input is appreciated.

Can work independently/freelance if shes not the primary applicant.
If shes the primary applicant, she would not have the unrestricted access to job market that a dependent has. Please search for other posts if you need info for the primary applicant.

Good question and I dont know the answer to this in entirety. What I understand is that if she's the dependant/ derivative on the 485 application and has her own EAD, she can work independently/ freelance. Her 2 options would be to work on another company's payroll on W2 OR work as an independent consultant by Incorporating her own company.
Guys who are more knowledgeable in this, please chip in..
I am pretty sure that the primary applicant who has an EAD cannot freelance/ work independently but has to work for his original company OR transfer to a new company after invoking AC21 after 180 days but the new company has to be willing to take up the green card sponsorship application on behalf of the applicant....input needed from senior folks

hi i'm not senior member but i have my own attorney and i verified everything...i have started restaurant business on my wife EAD....she has formed her own corporation....thank you.....

Once your wife has the EAD, she has the leverage to set up her own company and can pretty much work unrestricted. Check out other posts and also consult some gurus here. I know at least one person who just received his GC and was running his show under his wife's name (and he made a darn lot of money in the process). Good move and good luck.
