I-140 Processing delays (Letter to Ombudsman)

I've sent 7001 to Ombudsman , Contacted Congressional offices and ultimately filed a Service request in Nov 1st week. After all this NSC opened my case yesterday Dec 9th and the status changed to "RFE sent" - there you go ! They bought at least 2 months extra time.

What a bunch of jokers at NSC - my case was extremely straight forward

My husband's I-140 is pending at TSC for an year now and employer is not agreeing to sign on form 7001. Can we send an e-mail to Omburdsman and expect some action to be taken?? does it help?

I received a answer after 2.5 months.
The Ombudsman said, Proccesing times August 2, 2007, EB3 ROW, my I-140 is processing on time. My I-140 EB3 ROW was filed on August 22, 2007.

My lawyer received it on Dec 16th - they said that they need at least 2 weeks to answer the RFE. They also mentioned that the RFE doesn''t ask for any specific paperwork , its like a Question-Answer Form.

a) Why do you need this guy
b) Can you find an american instead of this guy
c) How you benchmark performance in the company

My I-140 was applied in May 2007 but I never got the approval until recently. My company opened a service request 30 days ago and I got the approval on Dec 12th. Service request helped in my case.

Is this not the reason they (U.S government) have a process to issue certificate from labor department to prove that the company could not hire an American for which some of us had to wait 5 years!!! Talk about abuse of power by USCIS.....

I have recently contacted CIS Ombudsman (3-4 Months ago) regarding my I-485 application.
My lawyer is perpetually suggesting it may jeopardize the case.

Is it true? and Why?

USCIS has not even posted January processing times till now. This should have been published by Dec 15th.

God only knows what game they are playing.

I just had my I-140 approved few days ago. I applied concurrently during July fiasco to NSC.
My online status says: Approval Notice Sent.

I guess that means my I140 is approved.

I am EB3 - India.

The labor certification submitted in support of your petition indicates that the minimum education requirement is "bachelor's degree in computer science, compluter Applications, Computer Information Systems, Electrical, Mechanical, Mathematcis, Physics or its foriegn Education Equivalent".It is noted that the beneficiary received a 3 year bachelor's degree in Mathementics.

However, the term "euivalent" is not defined. Please provide documentary evidence to establish the definition of "equivalent" as it was defined in your labor certification process. Such evidence may include , but is not limited to, a statement from the dol explaining the interpretation of the term as certified, copies of the petioner's recruitment documentation and/or evidence that no U.S. applicant's for the position who posses the same or similar qualification as the beneficiary wer disqualified from selection

Hi everyone,

Just wanted to let you know that my EB3 I-140 got approved today. I am a July 2007 concurrent filer. This wait has been frustrating and I've had to let many good opportunities pass by. I had, in the last 2 months, opened 2 service requests. I am not sure if they did the jobor may be the time has come when we will see July approvals coming in hordes.
