Gurus,

My new employer is getting ready to file for my I140 and I told them that I have an approved I140 from previous employer that I need to port the PD from.

Now, I recently found out that my older I140 was revoked by my previous employer(it happened after 180+days of 485 filing). Should I let my lawyer know of this? Can it do any harm?

What is the process to port the old I140 date?

I think all you need to do is provide your copy of I 140 , you already filed I 485 and you have a A number which you can use in your new I 140 filing and it should automatically get linked . Your attorney can draft a letter asking to retain your old PD by the way are you porting from EB3- EB2 ???

Thanks Andy. Yes it is a port from EB3 to EB2 . My priority date is dec 2006.

180 days rule is not about 140, it is for changing the employment using AC21 after 485 has been pending for more than 180 days.
