No 140 PP for Labor substitution case?

I had applied for Labor sub 140/485 on July. When they do bring 140 PP back, can I opt for premium processing even though my case is a Labor Subsitution one?

Dear Friends,

I have availed a LC from my employer with PD june/2001. Few questions are bugging me..

a) Is LC Sub I140 processed in different manner than Normal I140?
b) Is LC Sub I140 is being scrutinized more regarding skill and education matches than the Normal I140?
c) Does LC Sub I140 take longer than Normal? I am hearing many July 2nd Filers have got their I140 Approved.
d) Does the PD carry over to new beneficiary?

it is typically scrutinized more because of the amount of fraud that has gone on with labor sub.

Approval itself should take same time as other I-140s. Dont know of any I-140s getting approved for July 2nd filers, most are hunkering down for a 7-10 month wait.

PD does carry over to beneficiary (otherwise there would not be so much fraud). If PD was reset, and only the requirements of placing a new job ad and recruitment etc were waived, LC sub might have been around even today. The PD-carryover coupled with massive retrogression is what led to a large amount of fraud.

LC substitution is not eligible for premium processing of I-140.

Premium Processing Service is available for the Form I-140 classifications indicated on the chart above provided that the case does not involve:


1. A second filing of a Form I-140 petition while an initial Form I-140 remains pending;

2. Labor Certification substitution requests; and

3. Duplicate Labor Certification requests (i.e., cases filed without an original labor certification from the Department of labor).


USCIS is prescribing these additional conditions of availability on Premium Processing for Form I-140 because of their special processing requirements, including locating and transferring other files or documents internally and requesting initial evidence from an outside agency, that make it difficult for USCIS to guarantee that it will process the case within a 15 calendar day period.
