Smile Premium processing request honored! (Approved I-140 without LUD changes)

USCIS is doing this to me the second time. They did the same with my EB3 I-140 and now with my EB2 I-140! I am really upset about the way this lazy NSC is handling I-140s.

My EB2 I-140 was filed with premium processing on 9/2/2010. Today is 09/16 already and there are no hopes of my case getting touched or approved in 1 day! How do I know, because there are no LUDs since 09/03 (when the premium processing receipt issued).

Same thing happened with my EB3 case when I requested for premium processing (at NSC) they gave back the premium fee and said they cannot complete the case with in 15 days! So why are they even having this premium service to fool around....

Is there any thing that I could do about this?

Check my next post on this thread. My I-140 got approved without any LUD changes! Came to know approval from attorney's office!

Smile Approved without case update on USCIS website

Just got a word from our attorney that my case was approved on 09/08/2010. In my case USCIS did not update the website with the approved status! Not even a soft LUD.... I don't know their operating standard!

Thanks for many of you reading my post! So now you know even with out USCIS website update there is a chance that ones case would be approved.

Lesson learnt: Always check with attorney!

Now on to the final hurdle! I-485.

I am holding MCA with 10+ years experience. My degree got evaluated to be equivalent to MS in US.

Just to let you know switching from EB3 to EB2 is not as simple as one would think. I assume you are aware of it.

To switch you need to start from Labor and be careful with the job requirements. And then your educational qualification and work experience.

Here are the EB2 minimum requirement.

JOB should require minimum of Bachelors degree with 5 years experience or Masters with or without experience.

what are your plans for I-485 filing? are you going to interfile your existing EB3 485 application with EB2 I140 or file a new 485 application for EB2? what is your lawyer recommending?

Our lawyer requested as a interfile while filing the new I-140. EB2 dates were current at the time of filing I-140 so that was possible. Otherwise we have to send in a copy of the new I-140 to join the I-485 when one's PD is current. I am waiting for copy of the I-140 to follow up on I-485 with SR and Infopass.

I am using the existing I-485 to avoid confusion and delay. That is what is being recommended by USCIS in many AILA meetings that I am aware of.

Yes I changed job and my new company did the EB2 filing. It took roughly 9 months from starting the Ad, recruitment efforts, filing and approval.

Thanks Raj. Is interfiling request just a one page letter to USCIS or anything more involved? I presume you also did the priority date porting at the same time.

New 485 is not recommended as you have to undergo all the hassles of fingerprinting, medical, background blah blah blah....Specially if your Eb-2 date is current and your case already being pre-adjudicated, interfiling is very much a common sense.
