Default I140 RFE on work experience- letter needed from HR or ex-boss?

Hi

I got an RFE on my I-140, asking for evidence of 12 months experience in the form of letters from employers (NSC, EB3, Labor approved in PERM, Oct 2006)

The HR of my prior employer is not ready to give me employment letter, however, my ex-boss (to whom I reported, and who is still in that same company) has given me a letter

My questions are- (1) What exactly is "Employers" supposed to mean? Does the letter NECESSARILY have to be from HR department?

(2) The job title in my approved labor is "Systems Productivity Engineer" while on the experience letter from ex-boss, it is "Productivity Systems Engineer". Is this a problem? Does USCIS check exact match in job title?

Any help is greatly appreciated!

Default anyone can give exp letter, HR, Mgr, co workers etc

If the employer has HR dept then you can get it from HR. Infact, any one can give you a letter director, manager etc on the company letter head.

Alternatively you can also get reference letters from your ex-coworkers even though they are not working for that company. In this case I think they have to notorize the letters.

If your manager gives it on company letter head...its perfect.

if he gives on white paper, get it notarized. That would serve the purpose.

NSC will accept it.

You can even obtain a letter from co-worker. If your ex-boss issues a letter on a company letter head then notarization not required, otherwise get a notrarized one.

"Systems Productivity Engineer" is a future title/job - So getting a letter from ex-boss for "Productivity Systems Engineer" (i.e. your past title/job) will not create any issues.

Thanks for all replies! I worked with 2 companies. I am getting a letter from HR of one company and for other company, the letter is from my ex-boss (both on the letterhead)

"Systems Productivity Engineer" is mentioned as the alternate occupation in my labor. The RFE mentions that I need to show experience in the offered job, or in the alternate job for a minimum of 12 months. So as I understand it, they are asking for experience letter in the alternate occupation (Systems Productivity Engineer)...is my understanding correct? If yes, my question (please excuse me for the repetition) is - Does USCIS check exact match in job title?

I know people who got RFE when they submitted letter from their co-worker, this might be in some cases, I am not trying to discourage you if you are doing so, but wanted you to give best shot as you have to answer the RFE. If you have no choice then give a try, meantime try to get your experience on the letter head so that if you get RFE again so that you will be on safeside

(1) First employer letter is from HR Director

(2) Letter from the other emplyer is from my ex-boss (to whom I reported and who still works for that same company)

Will these 2 letters suffice? Do I still need affidavits from coworkers?

why received an RFE?? Have you not submitted the experience letters before either from co-worker or from company??

Default Am I safe with this evidence?

It was my lawyer's mistake. He originally sent only one exp letter showing 9 months experience (it did not contain job duties also)

I am in EB3 and labor was approved on basis of bachelor's degree + 12 months experience

The rfe is asking for evidence of 12 months exp in the job offered or in alternate occupations. To reply to the rfe, I obtained the following 2 letters

(1) One letter from HR director (9 months workex) for the 1st employer
and
(2) another letter from ex-boss (10 months workex) for the 2nd employer (could not get the letter from HR)

My question is- will the above 2 letters be sufficient for I140 approval? Do I need anything more?

you should be fine. Just make sure the content of the letters describe the job duties that are similar to what the LC specifies. I had a similar RFE and it was approved soon. Although my RFE was in the LC stage. You should be fine... Good Luck!

of all the above proofs, coworker letter is probably the most easiet to obtain.

regarding "I read in one of the posts that you should not send more than what they ask" - im not sure bout this either. may be ur lawyer can comment.

in my case, other than current employer, I only have worked in one company for 3yrs. the experience letter neither has appropriate jobtitle nor did it talk bout nature of work. the HR promptly refused to reissue any modified empl letter (even tho the company is big sized and i had genuinely worked there and gotten awards etc etc). My lawyer asked me to get 3 notarized coworker letters stating nature/duties of job, in what professional capacity and which client accounts i had worked on. i got those from excolleagues and thankfully LC and 140 (eb3) went thro wihout rfes. However i dont know if i just got lucky or did they read/believe the coworker testimonies..

chk with ur lawyer; i have seen response to rfe for other colleagues from my company, the lawyer attaches a letter at the front explaining the situation and LISTS out the supporting documentation. in such a case, if the last item is "coworker testimonies", along with other important ones in the front, i dont think its conveying anything -ve.

Default 5yr experience RFE

Hi,

I got an RFE to prove that i have 5 years experience prior to my priority date. I worked for Big indian consultancy but didnot formally resign while leaving the companey. I am plannning to submit supervisor affidavits. Can some one shed some light, to see if those will be suffitient. I saw some people getting denials after experience RFE and worrid abt what i should do.
