Default 3 Years Degree and I-140

Hello,

I wanted to get your opinion about this case.

I have a 3 Years Degree in Scince from an Indian University
1 Year Advance diploma in Electronic Commerce from a Canadian University
2 Year MBA from a Canadian University

Plus 10 Years expererience
My Labor is in EB2 Category

Minimum Labor Requirement: Bachelors plus 5 Years experience in Comp Sc., Business or Engineering plus 5 Years Experience

Or Alternative qualification is Master plus 1 year in Labor.

Nowadays, I am hearing there are RFE's on 3 Years Degrees. What is your opinion? Appreciate your reposnce

You may need a detailed and comprehensive credential evaluation done by a professional evaluator showing that your degree is equal to a 4 year US bachelors. As far as I know You CANNOT combine diplomas for GC, it can only be done for H1B.

Does your GC requirements say that foreign equvelient qualifications are accepted? If not that will be a problem.

You might have issues getting this 140 approved under EB2. (There's no such thing as an EB2 labor. Eb2 or Eb3 is requested when you file for I-140 based on LC job requirements and your own qualifications). Was your atorney confident that this was approvable under EB2?

Anyways I got help from Sheila Danzig at http://www.degreepeople.com/. My case was similar to yours. Her reports are a bit expensive but very comprehensive.

Yes, I did an evaluation of my 3 year degree and 1 year Post Grad diploma from leading universities. The professional evaluator said it is equivalent. Foreign education acceptable column is also checked 'yes' (just looked into the copy of my labor). My lawyer thought that it will not be an issue. Will my Masters degree help?

Sorry, I did not realize that you had a Masters. Then of course I don't think you will have any issues. But just to be sure check with your attorney if you need to send an evaluation for your Masters if it's not from US.

My Lawyer told me to do an evaluation JUST on my 3 years BSc degree (Delhi University) and 1 Year Post Grad Diploma in ECommerce (Ryerson University Toronto). He asked me to leave my MBA (2 Years) alone. I am at a loss why he told me NOT to use my MBA for my I-140. He said it is 'safer' to just show these two for my EB2 I-140.

Any Clues.

Default I am in the same boat, what have you found out?

Hi

I am in the same boat with 3 years b.com+2.5 years of US Masters in information systems. Labor says Bachelor degree of 4 year is required and i have applied in EB3. Under the special requriment of # 15 it says person should have a 3 years prior experience in the area of expertise that i do possess...what are my chances? I am worried.

Make sure you have a detailed evaluation handy just incase..

OK, if you did have, at the time you applied for labor, one of the following two, then you should be OK:

1. Bachelor's degree + 5 years of expirience ( you have Bachelor's according to your evaluation) or;

2. Masters degree + one year of experience (you have MS).

If one of the above applies to you AT THE TIME you filed labor you will be OK.
Anyway, stop worrying now. Wait and enjoy your life.

My attorney got it done through 'World academic research center, inc'. I don't think was expensive. The RFE response including the evaluation was 87 pages long.

Anyway since you haven't yet got an RFE, I wouldn't really worry about it.

Hey Glus !!

DID YOU READ MY LABOR CERTIFICATION (I am just kidding !!)

I looked into my certified labor document:
It SAYS

Bachelors + 5 years
(My evaluation said Bachelors : BSc + 1 Year University post grad diploma)
My Lawyer left out My Masters

Alternative qualification
Masters + 1 Year


What is the relevance of Master plus One (1) Year (but not 2 or 3)? I am curious.

Any ballpark on how much they charged? Shelia denzig i think charges around 1000 $.
Also, who was your attorny. My company lawyer is a big law firm and very very expensive.

I think it was somewhere between $300 - $500. Since my employer made the payment I am not sure of the exact figure. You may checkup on their website.
