Just one question -- what is the basis (i.e. citable source) for saying that you cannot get a salary increase of more than 5%? I have not encountered this figure in any document or USCIS ruling. I am particularly interested in this because my salary has increased dramatically since my green card process started, and is likely to increase yet again.

I understand that only in-line promotions are possible while you wait, but I have not come across any explicit limits on salary increases. It may not be possible to get in-line promotions with large salary increases in all professions, but it is possible in some.

It is a matter of policies in big companies. While some employers have been flexible, most big companies or even educational instituions or non profits have protocols that they follow and the HR departments are very insensitive and objective to the benificiary's needs unlike consulting firms or employee friendly companies like microsoft, google. Believe me, a lot of people are not taking promotions or pay hikes just because their organizational policy would void their Green card petitions

But why worry now that the July Visa Bulletin has been
reversed? Besides I hear they are approving Employment
Based green cards really quickly! I think they will clear all the
backlogs soon!

Employment Based Green Card application process consists of three stages: PERM/ Labor certification. the I-140 Petition, the I-485 petition also known as Adjustment of Status.
By definition, therefore, there are at least three different queues you need to think about, and not ONE queue of backlogged applications

All right… so what?
I meant to say the backlogged “Adjustment of Status” applications.
They will be clearing up these backlogs in the next year or two.
Backlogs in Adjustment of Status (AOS) applications are caused mainly by the lack of sufficient “visa numbers”.
250,000 backlogged AOS applications before June-2007
Of these, approximately 50,000 approved by USCIS
Therefore, effective number of backlogged AOS applications before June-07 = 200,000
Number of NEW AOS applications filed between Jun-Aug'07 = 250,000 (conservative estimate)
Total number of pending AOS applications = 200,000 + 250,000 = 450,000

Those numbers…
Those numbers seem to be inflated. I mean, what’s
relevant is how many applications were submitted
from my country.
Conservative estimate for pending AOS applications from India = 35% of 450,000 = 150,000
Conservative estimate for pending AOS applications from China = 30% of 450,000 = 135,000
If you are from another country, you are only in a “slightly” better position, please continue to read.

So?
What do these numbers mean? What prevents them from processing those
applications within two or three years?

Because of the limit set in 1990-91, only 140,000 Employment based green cards may be approved per year
Of these, no more than 7% can be allocated to applicants from any country
Dept. of State released the distribution of green cards for the year 2006: http://travel.state.gov/pdf/FY06Annu...bleV-Part2.pdf
China and India got around 9000 green cards in EB1+EB2+EB3 due to maximum per-country limit of 7%
Therefore, time to eliminate the current backlog from China =135,000 / 9000 ~ 15 years
Time to eliminate the current backlog from India = 16 years

But I am not from India or China!
So, if I am not from India or China, I don’t need to worry!

Priority dates for EB-3 applicants from all the countries have been severely retrogressed for a long time, also for the reason of limited visa numbers.
As long as the visa numbers are not increased, EB-3 applicants of all nationalities will likely continue to experience severe retrogression
Although this is a less serious issue for EB-2 applicants, no one can predict how and when the priority dates for AOS will retrogress, thanks again to the way the limits I on the visa numbers

I already waited for 2 years!
My AOS application is not at the end and will be processed
somewhere in the middle.
Ok, so maybe if you are in the middle of the queue, it will take you 5-7 years to get your I-485 decision (not necessarily approval)
It means that for the next 5-7 years, even if you can change your employer, you cannot change your job title and job description
You also cannot accept a salary increase of more than 5% of what is mentioned in your “labor certification”, unless you can convince your employer to re-do your labor certification and then a new I-140

Big deal!
So I will do this same kind of a job for the next 5-7 years. What is the
big deal with that?
Ask someone who has been there! Is it as easy as it seems?
Imagine where you were 5-7 years ago. If someone had told you 5-7 years ago that you would be at the same salary/job title/job description for the next half a decade, would you have not done something to change that?
Every year there is inflation of around 3%. No salary increase for 5-7 years means effective decrease in salary by 3*7 years = 21% over the period.
The only way out is for you to get your employer to keep re-doing your labor certification + I-140 every 2-3 years, and keep trying to port your original Priority Date… do you really think you can do that?

But I like this system!
At least we are lucky that the system works,
and we will get our green cards eventually, if
not now.
Nothing could be further from truth. Please do some research on the Durbin-Grassley bill designed to virtually take the Employment Based green card applications to the grave yard, and effectively purge the community of “high skilled legal immigrants”.

I want my Receipt Notice!
Ok, but for now it’s very important that we receive receipt notices for
the AOS applications we just filed. And of course, we want our EADs.

Think about it. While you talk about receipt notices, you are postponing thinking about the wait you & your family will endure for the next 5-10 years
Receipt notice doesn't mean anything. Receipt notice is merely an acknowledgement!
Technically the application can still be rejected due to any reason including lack of initial evidence even after issuing a receipt notice!
You will need to renew your EADs every year until the time you get your Green Card. Please note that the fees for renewing EADs will increase.

But Receipt Notice IS important!
You cannot deny the Receipt Notice and the EADs are the first step to our
“freedom”
Far from the truth! What is the use of the receipt notice for an application that will tie you down to the same salary for next 5-10 years? Do you really want to go in the backward direction rather than make progress in life?
The present day Employment Based Green Card process will make us a large group of high skilled "UNDERACHIEVERS'
In time the job/ technology/ versions of software for which the green card was applied would become obsolete and this may become potential reason for rejection of a lot of the applications

So, what is your point?
So, can you please come to the point!
Yes, we want you to wake up!
There are no two ways about it!
The EB green card process will continue to be extremely slow, and applicants will continue to live in the state of limbo, unless the legislation is changed
We need to petition the congress to address issues such as per-country caps, the limit on visa numbers that has been set to 140,000 for the last decade and a half, and various other issues such as name check delays

What can I do?
What do you suggest I do? Are we entitled
for a fair immigration system? Can we “high
skilled but temporary workers” influence
anything or anyone to make a change?
Of course, we have the power to make the difference.
Do you think it is okay for YOU to not do anything when YOU have the capacity to participate in the rally to change the system?
We can influence this change for us and our families. If not for our careers would we stand-up for a better future of our families and our next generation! Would we?
