Default H1-B Renewal / I-94 expired

Hello,

This is the first time that I post something on your forum.

I have the following situation:

I transfer my visa to a new employer a year and a half ago. However, I did not re-stamped my passport to show the new authorized period to work in the US. Now, eventhough I have an authorized visa until Feb. '09, my I-94 and my current visa stamp expire on 10/01/07.

My question is: Could I stay with in the US after 10/01/07, since my visa renewal authorization has an I-94 that goes until Feb. 09? Or i have to leave the US and have my passport re-stamped.

I hope you can help me.

You are absolutely fine because you have a new I-94 that came with your H1-B transfer and that goes upto Feb'09. That new I-94 effectively replaces the I-94 you got at the airport when you came in. If you leave the country though you have to get a new visa to re-enter.

You need not go outside USA for this, you could stay as long as you have a new H1B with new I-94 that comes along with you new H1B. But make sure that you are not crossing your 6 years limit if you have no pending GC process. Hope this will help you.

Post H1-B Renewal / I-94 still valid

I moved from company A to B . i have new valid petition till April 2010 ,I 94 valid till april 2010 . Visa is valid till april 2008 and has the company A name on it .
can i get visa stamped again in mexico or canada or do i have to go back to india - where i first got my H1b
what are the docs required
