H1B extension applied-Can i work on Receipt Notice?

Hi friends - I have applied for my H1B extension last months. I just recd. my receipt Notice (RN). My current H1b expires in March 2008. Can i continue to work on the RN even if i do not get the approval. Is there some info on the USCIS website which says that one can continue to work when an H1B extension has been filed for. If somebody can please post the link here that'll be really helpful. I need to show this infomation to my HR other wise they will take me of the payroll in march.

I am think of paying the premium processing fees. Are they processing the H1's in 2-3 weeks now.? or does it take longer now for premium.?

You can work upto 240 days after filing the extension, while waiting for a result on it. See the second page here ("What if I file on time but..."):

Premium Processing is still there for H1, takes 2-3 weeks.

Friends, I'll completing my 240 days in 3 weeks, what do I need to do now?. My extn case still under processing since Jul 09, 2007 (VSC). (I got my EAD last month, I don't want to use that)

any suggestions?.

You can apply for premium processing. I had applied for a regular transfer once, and then the company paid extra for PP. USCIS was quite good in connecting the pending file with the PP request. With 3 weeks to go, you can shoot for PP.

I guess PP sometimes is really worth it.! It's worth spending the $1000 for peace of mind.! There are mixed opinion of folks where people have been saying that even the PP takes 3-4 months.! I hope that is not the case. Good luck watzgc.! The H1 will come thru..don't worry>!

You can work for now...

I have applied for extension using premium processing(recently) and it took me 34 days.(With RFE, vermont).So, if you opt for PP, you should be alright. Good Luck.

It is 240 days from your current I94 expiration. So, if your I94 expires in May 2008 then you can work till Nov 2008. I know this for sure since I have been there. One of my extension took 11 months in 2002.

Please see below for the exact rule...

Under 8 CFR 274A(12)(b)(20), as long as the H1B extension was filed prior to expiration of your current H (and it sounds like it was), you can keep working for 240 days past the date on which your current H expires. However, if your extension application is denied, or your petition is still not adjudicated after 240 days, your employment authorization ceases.

yeah. In my case I went for PP on my I-140 4 weeks before they said no-more-PP-for-I_140.
In immigration matters the faster you can get a closure, the better.
