Unhappy Lost I797 Form

Hi, I lost I797 form during my travel. I have Photocoy of the document. Looks like it will take 6 months to get duplicate copy from INS. Now I need to go India for family emergency. Is there any problem i will face with not having Original Copy of I 797 Form at Port of Entry. Please Advice...

Thanks,
Lakshman

Sorry for incomplete info.

I lost I-797(A) form of H1B status. I do have stamping on my passport with Current H1B term.

I have Original I-797(C) (Employer Copy) with me. is it going to help me to re-enter in USA..

You dont need the 797 unless for future applications for extensions or visa revalidations abroad...for reentry purposes the unexpired stamped visa should suffice.
If at all they do ask you for the original copy ... show them the photocopy along with the employer copy. The worst that could happen is that they will call you for a secondary inspection, at which time you can get a company letter as well as reciept notice for a duplicate request for I797 ...
