Default H1B Transfer Question

Hi - I'm posting this for a friend.

She was in US on H4, applied for H1B (change of status) through a consultant, got it approved with an effective date of 9/22/2008. The consultant has not found a project for her yet, and has asked her to find projects on her own.

She is able to find some projects, but these employers are asking her to trasfer her H1 to them.

Given that she has not worked and does not have pay stubs from the current consultant, would she be able to file for a H1 transfer? (The H1B petition is approved with an effective date of 9/22/2008, and the attorney got this notice on 10/3/2008).

If so, what is the latest date by which she can apply for H1 tranfer without paystubs?

Any help would be highly appreciated.

Sure.

Also, can anyone tell me if its beneficial to not apply for SSN so that my friend can make the case that she is not being paid since she does not have SSN?
