Default Urgent.... laid-off on H1B

I just got laid -off and my H1b got activated on Oct 1st, can someone please let me know how much time I can be unemployed before I get a new job and initiate a h1b transfer without getting into trouble.

A month should be fine but every h1b petition is scrutinized on a case to case basis. If you were using h1b for a long time - then it is different, but as you mentioned it is only 8 days, you may have to get it transferred ASAP.

Default H1B-transfer timeline

Hi,
very conservatively within 30days but realistically if you are able to find a job & initiate H1B transfer within 60days you`ll be fine . Some laywers are of opinion that there is no RFE if H1B is transfered within 30days & there might be an RFE between 30 & 60days - & some say that if you get H1b transfered within 60days you will have absolutely no issues & everything will be smooth - which was also my experience.

Also my company said that, they won't immediately inform USCIS that they have terminated me .... does that help my case......

you need to find an employer and "transfer" your h1b ASAP, the longer you delay, more problem it will be. As USCIS most of the times asks for paystubs etc.

Legally there is no grace period. Generally CIS is lenient on this but in any case if it exceeds 6 month then you are subject to 3 year ban for entering the country. CIS could deny the extension but approve H1B if they decide that you are out of status(If you are not able to provide recent paystub). In that case you may need to go for stamping. But I did not hear any case like that.

Is paystub important only while doing an H1b transfer or do we need paystubs in all circumstances? Can I be under a consultant without running paystubs until I find a project?
