Question on substitute labor/approved 140

Hi Guys

Here is the situation -

Subsitute labor was used & 140 was approved. The consultant left the company. The same labor is used for my friend who's 140 & 485 were filed concurrently last month. The attorney is not reachable. Can labor with approved 140 be used for new 140 & 485 ?

As per my knowledge , it cannot be used.
Any information ? Gurus please reply , this is serious.

This friend's old labor is still stuck in Backlog center.
