Default ITIN to SSN and Tax Rebate

This is FYI.

We got my wife's SSN earlier this year but had already filed our 2007 return and had used her ITIN. Here is what I found out on the IRS site about the rebate in this situation:

Q. If I currently have an ITIN and file my return but later this year get an SSN, can I amend my return to get the payment or will I need to wait until I file my 2008 return to claim it?

A. You will need to wait until you file your 2008 income tax return to claim the economic stimulus payment. [New 4/14/08]

I think they updated this rule recently. I was in a similar situation and if I recall correctly, I had read that we can file amended return and get the rebate this year. Luckily, we got my wife's SSN a day before the deadline and could file with SSNs.

Default Called IRS

I just called the IRS and the rep told me that if the spouse didn't get her SSN in 2007, she wouldn't qualify for the rebate. I'm not sure whether it makes sense or not since the IRS may not know whether the spouse got your SSN in 2007 or early 2008 before filing the tax return. He further told me that we'll "possibly" get the rebate when we file our 2008 return. Even the IRS site uses careful words and says you'll need to wait till you file your 2008 return to "claim" your rebate.

This was IRS prior written advise:

Not eligible at the current time? If your circumstances change and you become eligible after you file your 2007 federal tax return, you can always file an amended return using Form 1040X. File the form after April 14, 2008, and allow 8-12 weeks of processing time before making any inquiries about your payment. See a sample with instructions.

If anyone affected by the ITIN rule is located in the Silicon Valley / San Francisco area, please PM me. A reporter for the San Jose Mercury News is doing a story on this and he wants to interview local people affected by the ITIN rule.
