Virginia information technology company to pay nearly $1.7 million in back wages to H-1B non-immigrant workers following U.S. Labor Department investigation
STERLING, Va. — GlobalCynex Inc., a Sterling information technology company, has agreed to pay $1,683,584 to 343 non-immigrant workers after a U.S. Labor Department investigation found the company violated the H-1B visa provisions of the Immigration and Nationality Act.

An investigation by the department's Wage and Hour Division found that employees hired under the H-1B program were not paid required wages from March 2005 through March 2007. Wage and Hour Division investigators also found that the company charged new H-1B workers training fees ranging from $1,000 to $2,500 that were in violation of the law.

"This case underscores the firm stance the Wage and Hour Division is taking to ensure that employers do not undercut American workers by underpaying temporary foreign workers," said Corlis Sellers, regional administrator for the Wage and Hour Division's Northeast Region.

The H-1B visa program permits employers to temporarily hire foreign workers in professional occupations such as computer programmers, engineers, physicians and teachers. H-1B workers must be paid at least the same wage rates as are paid to U.S. workers who perform the same types of work or the prevailing wages in the areas of intended employment.

The Wage and Hour Division enforces the H-1B wage provisions of the Immigration and Nationality Act, in addition to other federal laws pertaining to wage payments. For more information about the H-1B program, visit the department's Web site at http://www.dol.gov/compliance/audien...gn_workers.htm.

I hope DOL/USCIS Sc*rews these employers and s* them hard. Blood suckers to lot of people on this forum. A handful of companies like these have forced H1B visa holders with hardships on the ground and challenged the viability of the skilled based immigration programs.

I doubt these kind of actions will help much. The companies will pay fine and get away with this and try to find more loophole to escape future issues. The punishment should be severe and the employers should be held accountable. If they ban the company then they will start a new company so that also will not help. Also preventive measures also should be needed for these kind of issues.

Here people should know the difference between blood suckers and visa violators.
Blood Sucking aspect is subjective and may or may not have any bearing with Legal Violation.


Blood Sucking
If your company is charging $200,000 from its clients for your services and paying you only $80,000, you may call this company a blood sucking company but it is not in violation of any immigration related law or rule because it is paying you equal or above market wage.

Violators
On the other hand, a company may be paying you 90% of the billing rate but due to no client, there happens to be no billing and you are paid only $40,000 in a given year. You may say that this is not a blood sucking co but it is still a violator of immigration laws. This is what matters to immigration authorities.

For discussion here, please focus on violaters based on data.

It says, if equally distributed among victims, it is $5000 per victim. Nothing for consulting company with 400 employees. More, I believe blood sucker should be punished more rather 90% paying companies are getting punished.

Someone mentioned correctly. Criminals in eyes of immigration department may not be criminal in eyes of God where as equally true otherwise.
