My concern is that strictly from a viewpoint of logic, if Americans already have enough Americans to do the job, why would they need H-1B in the first place? If H-1B was a temporary visa meant to supply temporary labor then having enough permanent American laborers would erase need for H-1B, right, so you wouldn't need to hire H-1Bs in the firsten place. That is why I am confuse.

Matt,

Using immigration status i.e. H1B or similar as SOLE criteria for layoffs is discrimination based on nationality or nation of origin. Secondly, I doubt you are German. I have lots of German friends and I know for sure that this is not "Broken German English". Will you be man/woman enough and reveal your actual identity?

What's there to get confused about this??

When demand was more than supply, H1B's (so called temporary workers) were hired.
Now Mr Senator's point is, if you are reducing work force, fire these temp's first so as to save American's jobs.

I do condemn Senator's actions, for it discriminates immigrants. As per him, American's lives/dreams are more important than immigrants.

H1-B is not temporary, you can have an H1-B with the intent to immigrate.

You are right I am not a German. I am an American computer programmer who got laid off when the company I worked started hiring more people from India. I thought my name Matt Krause sounded German so I tried to fool you and now I see that did not work.

H1B is dual intent visa, providing a path to Permanent Residency (eventually naturalization).

The word "Temporary" associated with H1B is highly misunderstood and misinterpreted, particularly by anti-immigrants.

There is & should be no difference in the status of a H1B employee and US citizen working for same type of job for same company. Now don't you think it amounts to discrimination picking one and letting go the other??

That is not really true. H-1Bs were never part of an "intent to immigrate" application. There were specific rules that forbade this.

Default I agree with Matt

I totally agree with Matt, US hired so called software only programmers for Y2k & Mainframes only, now the problems are fixed they should leave.

Instead these so called software only (mostly) programmers opened up a black market for Green Card by selling labor substitutes and created a huge backlog and genuine people got stuck. Finally USCIS realized that and closed the labor substitutions, but still lots of those people are waiting to get Green Cards who got fraudulent labor, which should be investigated fully before issuing any benefits???

Not true. The meaning of "temporary" was a legal definition of the H-1B program. It is against the intent of the program to use H-1B terms to define "immigrants" since H-1Bs are not, by laws, immigrants, and therefore cannot be discriminated against as immigrants.
