Default citizenship and prositution

My friend who is a Green Card Holder got caught ( not sure they took him to jail) for solicitation of prostitution by undercover cops. The citation is for solicitation of a prostitution. i.e. paid money to get X favor.

What are his effects on citizenship ? He is planning to file it as he is already eligible.
They is some thing in N-400 saying that the applicant has to show good moral character.

What are his chances of this showing up in a background stuff when he goes for a new job?

Of-course he will speak to an attorney. But wanted to post here to see if anybody is in the same boat. And please, don't make this a stupid moral discussion.

Are you sure you are posting for your friend and it is not you yourself got caught.

If it is really your friend, you are a very good friend.

Or are you the prostitute your friend was soliciting?

If you dont have anything constructive to add, please dont bother. Not here to start discussions on whether it is for my friend or me, is it moral or not etc. Thanks

Default Cited but not charged

I believe your friend should be fine. Citizenship requirements are tolerant up to misdemeanor charges. Felony charges on the other hand needs careful management with the help of an attorney. Since your friend has only been cited and charged, I think it will not be even taken up as an issue. However consulting with an attorney would be a wise thing to do.

One more thing to add: Soliciting offense is dealt with differently in different states. But to my knowledge it is legal in Nevada but in many others it is misdemeanor. The punishment also varies by the state and could be a stiff fine or imprisonment or both. Leniency is afforded for the first time offense. A misdemeanor charge might mean a permanent resident or a nonimmigrant worker might not be permitted into the country when he/she returns. As I said talk to an attorney.

You should be fine Kiran, don't worry. I'd be concerned if the sex worker was found dead, or you were found with drugs. But this has happened to others before, no biggie. Just be careful the next time around though (till you get your citizenship!)

I know for the fact that for N-400, USCIS review the background much more than any other application including GC. This will definitely show up in your friends case if it is not dismissed by court.

If he was awarded any sentence, that will show up in his record and the IO will definitely raise this question during interview. I do not know to what extent this will affect his application status and please consult with an attorney to get proper advice.

Thanks
