View Full Version : Changes to watch out in 485 filing after july 30th till August 17th

I filed my 485 on 2nd July and I am in process of filing 485 for my wife soon. I wana document and ask if there anything different from my 485 filing. Also can someone provide a list of supporting documents that I need attach to her application. I do have a rough list of mine but i wana make sure i dont miss anything.

Thus can someone share the list of docs required for Spouse 485 application

Changes that I need to watch out ?

Form revisions I need to use for 485/ead/AP, I think fee will be same ie for
485 –> $325+$70, EAD --> $180 , AP --> $170 ( as released in update1)

I mailed my application to Nebraska, I am based in Florida … thus according to new rule should I send my wife’s application to Taxes?

Should I include my supporting documents like I20, SSN, EAD ( of OPT) etc in her application.

should i put some bright color note on application saying that i filed my application as Single on July 2nd and now filing my wifes application as i got married on July 29th ?

Do i need to put my original employement letter with her application too or the copy will do ?

I am not using a lawyer thus any help is appreciated.

Can you share the list of docs u are adding to her application ? Also where are u based and is there a reason why u selected TX ?

1> Marriage certificate.
2.> I-864 + employment letter (copy will do) + tax returns (last 3 years) + W2s (last 3 years) + paystubs for last 3 months + bank letter
3.> Proof of status for her (I-94s, I-20s, I-797, EAD, etc)
4.> Copy of her complete passport (including expired one if it exists)
5.> Her birth certificate / affidavits
6.> Copy of your I-140 approval
7.> 6 photographs of her
8.> Filing fees

You need to realize that 485 is a separate application when you file for yourself or your wife. So all the documents mentioned in 485 imply to your wife application too. Few changes need to be taken care
1.If 140 is pending or approved in texas your wife application should go to texas
2. If 140 pending attached the labor approved copy.
3. Employment copy instead of original.

Also do i need to add my tax return, my I20 and my paystubs with application. She just came into country so she does not have any tax rerurn of her own nor any I20 or any paystubs of her own.. Please suggest.

The tax returns, W2s, paystubs etc should be yours, not hers, since she is filing as a dependent. I'm not sure if you need to attach your I-20. I'm not sure if you need to file an I-134 but my attorney recommended me to file an I-864 although I-485 instructions are not clear on whether its inclusion is necessary or not. But I would say why not file it just to be safe.

Though its not mentioned it is good file I-134. You are not eligible for I-864.

Yes u are right about I-864. Any employement based green card like ours ( EB2/EB3) should not file it. Here is the text from the I864 form -->

Employment-based preference immigrants in cases onlywhen a U.S. citizen or lawful permanent resident relativefiled the immigrant visa petition or such relative has asignificant ownership interest (five percent or more) in theentity that filed the petition.

Yes, its good to file I-134 especially when she is on H4. Paystubs and tax returns are not required documents though a lot of people tend to submit them. Just an employment letter from your employer would suffice. You dont need to include your I-20 with your wife's application....However, do include her medicals, though its not part of the initial evidence......

2) I-134 ( convinced that they will need this even for H4 dependent )
3) did not ask for W2's or pay stubs
4) of course original medicals in closed envelope
5) all previous H4 approvals + I94's and color photocopy of entire passport
6) photos and required cheque's

My attorney filed for 485 on aug 2nd. But he filed with old fee and old 485 forms. He says i fall under july visa bulletin, so i can file with older fee.

Is he correct? Will there be no problem with my application?

Your attorney is right. Old fees apply and old forms are fine.
