Hello everyone,

I heard the WEIRDEST thing this weekend. One of my friends who is under the Eb3 India, PD Dec 2005 (yes no mistakes), was able to file like the rest of us under the July 2nd window. He received his EAD and 2 weeks later a Welcome letter stating the case has been approved.

Now How is this possible. Also what is the welcome letter supposed to be? Is it the approval of the GC?

We will never know how USCIS works. :p

Did you ask him to check his case status with I-485 receipt number ? What does it say ?

It is possible that one could get a GC irrespective of PD as long as the I-485 status is current irrespective of PD and if his application has been processed in that window. So during July fiasco its Current and if your friend's application is processed at that time then its not a matter when the PD is.






PS: I am not a lawyer and Its just my idea.

I think it should be a mistake from USCIS. I often read from forums that you should check with USCIS regarding these weird approvals.

You mean: In a window period of 6-weeks (7/2 to 8/17) in a chaoitic situation at uscis (while people are still waiting for RN/FP notices) -a miracle happened. Mandatory finger printing, FBI checks, Name Checks happened and GC card ordered. This is all too interesting. Make all of us optimistic

Let's say that person's background check was fast and quick
Meaning, there are very few people whose Receipt notices and FP notices were sent out by USCIS quickly around august 20th. May be one or 2 have given Finger prints in the same week. could be possible.
(In my case i also applied for Canada immigration and my FBI + finger print check was done exactly in the same window AND remember that this is same agency that does all of the back ground checks for USCIS as well. It is some where in West Virginia. I received a clearance and clean chit from FBI. Believe me i spoke to the officer 3 or 4 times as he called me during investigation and during the discussion he clearly mentioned it is the same agency that does the job for USCIS also.)

If something like above happened in that particular person's case, then yes technically IT IS possible to approve 485. Remember to approve a 485, there must be FBI Clearance, as well as visa number availability & date must be current.

It could be possible

485 applied on 07/02
Finger prints done on Augu28th

But the person's PD is EB3, India, December 2005!!! How is it possible???
And his filing date is somewhere in July 2007 and USCIS is processing cases filed in 2006!!!

You missed the point. Technically, the PD was current between 7/2 to 8/17

VISA numbers were available only between July 17th and July 31st.

It was unavailable from July 2nd to Jul 16th and Aug 1st - Aug 17th.

Regardless of what was available when. How did he manage to get an approval even without the FP clearing? Besides he got the approval 1 week ago when the dates are NOT current for Eb3 India PD of Dec 2005.

More importantly can someone shed some light on what a "welcome letter" is?

Wife2 : Oh Congratulations. I remember how excited we were when we got our welcome letters after our GC approval.

Person3 (who overheard only parts of this conversation) to Person4 : You know Couple1 applied for their GCs 2 months back and they have already got their welcome letters.

Not trying to discount the fact that this could be truly a mistake by USCIS. But hearsay is just what it really is : hearsay.

This is no hearsay. I am very good friends with this person. However I have not physically seen the letter coz he is based in a different city.

Is there a chance that he was talking about the welcome letter that is sent with the EAD card itself? That welcome letter is the same for EAD or GC (Welcome to the US..blah ..blah..)..

- can you post the exact text of the 'welcome letter'?

- did he receive something himself, or is he looking up receipt status online based on the receipt number from a check? (if he is misreading the receipt number from the back of the check, it could be someone else who got the GC while your friend here is opening bottle after bottle of champagne :D )

It is possible! I did my FP last month... I did it on a thursday and my 485 was approved on monday! I received my EAD couple of days back... LOL

Eb3 ROW, PD: DEC 2004, I-140 approved in 2006, I-485 RD/ND: JUN 24, FP: AUG 1, EAD: JULY, AP: mid AUG, welcome letter sent: SEP 17, received cards: SEP 22.

Lawyer said there's no mistake. I've heard of many other similar cases, as you can see on this thread.

It's not fair and all that. USCIS probably scrambled to adjudicate all the low-hanging fruit to minimize waste of visa numbers for FY2007, irrespective of PD. Cases that were straightforward and complete and were delivered by FedEx on top of the pile or something just got lucky.

Congrats to you. However your case is still understandable coz u were a June filer. My friend was a July filer, hence my confusion.

No. i am Eb2... so I have been current throughout since June except for that 1 month... however what I am saying is it is possible that u can get ur GC in days (in my case 3 days) after ur FP is done... So its not always true that a long window of opportunity is needed... if you are lucky enuff ie... dont know why they send a EAD 1.5 months after I got GC... and yesterday received approval for AP! sheesh.. why would USCIS waste time on a case that is already approved!
