Not alot has voted so far, but looking at this small sampling, not alot of people pre-2005 for EB3 RoW. I had my suspicions that USCIS was being extreme retro-ing RoW all the way back to 2001 when this mess started.

I don't think they were being extreme, I simply think that they refused to acurately assess how slowly the DOL will ever get thru the LC backlog.
There are probably still 50,000 ROW LCs with PDs that pre-date the current EB3 ROW cut-off date. If these were majically approved tomorrow, i'd bet that the cut-off date for EB3 RoW would not move and would (due to spousal and kids' GC) become 'U' by the end of FY2007.

DOS still believes that BEC will complete their work in FY2007 (they said so Sept bulletin), so they are still counting every LC in BEC against the FY2007 quota.

That said, the 2 month advance in Oct2007 matches how far EB3 RoW moved in EIGHT months last FY, so, clearly, the reality that BEC will not finish their job is sinking in.

About the poll... whoops, shoulda waited longer before saying most EB3 RoW are in 2005-06.

About the DOL BEC backlogs... well, they have been around before the retrogression happened in October 2005. Just that after Ombusdman got both CIS and DOL together, CIS decided to include the BEC backlog count into their demand analysis. I personally doubt DOL can get rid of their backlogs this fiscal year... too ambitious and given that applications for GC is still being filed annually, they wont achieve it.

Does anyone know how many visas are available for FY2007 for EB3, ROW.
