Hi,

My PERM got denied next day after filing 7th year H1B extension, Is my H1 will approve?
extension filied on Premium processing. what are the chance me to continue on H1 and green card process.

PERM filied: 12/10/2008
Audit: 12/19/2009
H1B ending: 02/19/2011
H1B filied for 7th year extn: 01/18/2011
PERM denied: 01/20/2011

Please let me know if know such issues...

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.

Would recommend doing an appeal for perm. That will keep perm active while your H1 gets processed.

You can still get a 1 year extension claiming that your PERM application is still pending. It all depends on the officer that the decision has not been made on PERM application.

The PERM is already denied and you can not get the extension based on the denied PERM.

How he can claim that "PERM application is still pending" when it's already denied!!! :)

Hope your issue is already resolved. But a friend of mine, his PERM application was also denied. But they filed an Appeal and immediately, next day, they applied for his H1-B extension (7th yr) and it got approved.
