According to this link, they are processing I-485 cases (for all) dated back to July 2007. It means if EB-2 India even becomes current in coming months, it will take an extra year to process I-485 before we will get green card. Please correct me if I am wrong.

The processing time with texas says they are processing application submited on July 17. So does that mean they will start processing my application but wait for the Visa number to make it approved?

Could be interpreted as something like that
- If there is no visa number, they might pre-process the application

First of all, chances of EB2 becoming current are not that great. Please do not have high hopes only to be disappointed at a later date. good luck though!

What this means is that at both TSC & NSC, the USCIS has already reached over the hump on the july 07 deluge of applications.

This is good news for people in two categories of july 2007 filers.

1. EB3 ROW and EB3 2001 India July 2007 filers, from now till june 30th, cross your fingers...For some of you lucky ones, your approvals should be coming in anytime between now and 30th.

2. EB2 India & China w/ priority <2004 april july 07 filers, cross your fingers in month of july 2008 for the approvals/results of your case.

Yes, my understanding is that once ur PD becomes current and the case becomes approvable (no RFE's), they will then request a visa number for you and u will get GC.

Technically what it means is that they are done processing your application and it is pre-approvable as of now and once ur PD is current and visa number request is fulfilled, u will get GC...as what the July 17 date means is that all applications till July 16th has been looked at and approved/pre-approved if possible. Moving forward they will start with July 17th cases..this is my understanding.

I agree with this interpretation. If your date is before what is shown on the processing times page, then your application has already been looked at. It does'nt mean that applications after that date have not been looked at.

In my case, I filed I-140 in Nov 2007 and received the approval last week. But, the I-140 processing date shown for TSC is only July 19, 2007. So, obviously they are working on applications way later than what is shown in the processing times page.

what is pre-approved ? Say for example there's a problem with the birth certificate on an application. Will they send a RFE for it as part of the pre-approval even though the PD on the application is not current just because the processing time is current for the application ?

Both mine and my wife's cases have LUD changed ( one 05/28 and other 06/11 ). But the status is still case received and pending.
We applied on July 2nd. Should we see change in status ?

Is the Received Date on the 485 receipt notice is the Mail room received date ?? or will they use 485 app data entered into their system date whe comes to Processing Times date that they consider as current wrto Processing Times (for example TSC July17th,2007) ??

My app received on June25th,2007(Received Date on RN) and they say entered the data on Aug1st,2007..So does this mean i am not current wrt latest ProcessingTimes released today (TSC)..

Still getting confused when talked to an IO..:(

I have the same question. My app received on Aug 7, 2007 but Notice says received on Oct 2, 2007.

To be on the safe side I think they will use the Oct 2 date for processing my application and not Aug 7.

Few more months I guess.

Does that mean they did not touch my file ?

Is your PD current? may be it does matter before IO touch the file..

This is not true,when i talked to an IO lot of times..

they would consider the date when our 485 data keyed into their system..

Which date is that? Notice Date? If they go by Received Date then mine should have been touched by now. My received date is July 2, 2007

I have talked to an IO too regarding my first AP... he initially said that your application was received on Aug 30th.. when I pointed out to him that that was when the notice was created, but the notice itself has a receipt date of july 2nd, he said well I cannot see that date, but in that case your application should have been processed. He suggested I should take an infopass. I got my AP soon after that anyways, so did not bother to take infopass.

My take is that low level officers only see the information in the online system, and hence they only see notice date and assume that that is the receipt date. Prior to july 2007, ND and RD were within a few days to weeks of each other so it was not important... but since most july filers have 2-3 months between the two dates, this has become more important and is coming to light now.

Lucky you. My I-140 has been filed on Oct 2007 and its not yet approved.

dont' be too serious about the dates, wildly rough guesstimate. I had two 140's, filed 1 month away each other, but difference between the approval dates were more than 6 months.

EB3 is "U" (Unavailable) for worldwide. Does it mean the USCIS will not process a single EB3 I485 application even the receipt date is before July 28, 2007 which is now the EB catagory I485 processing date.

EB3 485s will be processed, but priority will be given to those categories that have visa numbers available and if USCIS is overwhelmed, they may put on hold the 485 processings for those categories that do not have any visa numbers available

My Priority date is not current and is in 2006. So I guess they go by ND .. nothing sure with USCIS :)
