View Full Version : Does AP require less than 120 days before expiry for renewal?

My AP is expiring on 11/23/2008. EAD renewal can only be applied only if there is 120 or less days for expiry. Does the same apply for AP extension also.

My lawyer didn't want to file my EAD and AP before 120 days of expiration.

Why would anybody apply even before 120 days?

My attorney has mentioned to me that 120 day limitation does not apply to AP though the form 131 states that the renewal should be applied 120 days or less. I applied for my AP before 120 days and received the receipts notices. Hope this helps and others can share their experiences.

USCIS has been relaxed in case of EAD also. Although 120 days restriction is there, people applied from couple of days to a month earlier by mistake. USCIS honoured that.

Renewal EAD: You cannot file for a renewal EAD more than 120 days before your original EAD expires.

Filing Period for Renewal of an Advance Parole Document:

If you are applying for renewal of your advance parole document (I-512L or I-512), USCIS will accept and adjudicate Form I-131 filed up to 120 days before the date your current Advance Parole document expires.

Attorney specialize in these rules. So USCIS might have updated rules and put somewhere else. Can you request his/her source of information?

My atony said no need to file with in 120 days .
120 day rule is only for EAD .
