I assume that all the EB2 India who have decided to go for CP route will get their immigrant visas stamped in India. I noticed that New Delhi and Mumbai consulates posts a list of candidates due for immigrant visa interview at their website by the middle of the month. May be this list can give us an idea as to how many EB2 India will get their GC through consular posts:

This is the link for New Delhi consulate: http://newdelhi.usembassy.gov/visa_interview_dates.html

This is the link for Mumbai Consulate : http://mumbai.usconsulate.gov/interview_appt_schedule.html

This is the link for Chennai Consulate: http://chennai.usconsulate.gov/uploads/images/yWMjU032EdCBcZW2qhz3yw/ivapp0808.pdf

At the links mentioned above, you will find PDF documents telling us how many Employment based (EB2) people are scheduled for an interview during August 2008.

If we can search and locate similar links for Kolkata consulate, probably by mid August we would be in a position to find out how many EB2 India are going to get their GC's in August 2008 through CP route. This will also tell us how many visas USCIS has got to process/waste.

Gurus ... am I making any mistake here?

The earliest PD at mumbai is 2005 possibly Aug 2005; and the latest could be Jan 2008 which may be an EB1.

I am not a guru yet I will reply to your post.

You are correct; this shoul give a count of E2 from India. Also this would give the earliest and latest PD for that category. That shows why DOS was moving the PD forward for EB2 despite thousands of applications pending with USCIS.

Unless DOS move the dates forward, CP cannot use GC numbers as most cases with them are recent ones comparing to USCIS.

Going by the same logic, next year EB3 (ROW and I) might move forward as CP would have exhausted all E2 numbers; unless USCIS efficiency improve.

I doubt that many people will support this thought. So far the CP interview scheduled at US consulates in India does not even cross 100. I doubt that DOS was worried for these 100 people and that's why they set the EB2 India date to 1 June 2006. Its almost proved that unless USCIS act fast, majority of 20K visas that we have estimated ... will go waste.

It could also be that the estimate of 20K is plainly incorrect.

By moving date to 06/01, if DOS could clear all pending applications at CP, I don't see that as a bad move as that also gives USCIS, the flexibility to approve applications randomly.

Are you saying that USCIS has cleared all pending applications until 2004 and reason why DOS has moved the dates to 2006? And if that was true, then come October dates should stay at 2006 if not go back to 2003 or so. Let us wait and watch.

Why did you prefer CP route over I-485? I wanted that way with processing in Montreal but my lawyers recommended I-485.

Although CP is faster and that is whay I would chose but I was told that for CP you have and your family will have to travel to go to consualte which can be expensive. Then there are police certificates that one has to get and we all know how  easy it is to get one in India. Then you have to take time off from you job just for the visa. Also if CP gets denied then the person is stuck abroad but if 485 is denied then there is an option to file a Motion to Reopen.

Sundeep:

You are already benefited by AOS 485. How can you shift now. I know, there is a Form 8xxx. something, which would cancel 485, and provide CP. But knowing the level of efficiency and proximity, it is NO BRAINER to adapt that route.

Also, if Ron's Pessimism should hold good, NO ONE in the immgn. community is good to go. Dont worry tooo much, Look at the pace, you got July 07, Fiasco results. I donot think, the error cases are even 1% of total filing. Though, they initially messed around, people were benefited with that.

Again see the flow of EAD Renewals... Good and encouraging. Dont swing around, and stay tuned.. You are fine to go.. Trust me.. Have confidence in the system, it will deliver. :) Your good friend's advice.

What's your PD/RD/ND/ Category ??
