Post H1B visa Extention after I-94 expires

Hi,
My husband is going to complete 6 years in US on H1b visa on 21- Aug -2010, he didn't apply for GC. His I-94 is going to expire on the same date. Since he was out of country for 2 months, his employer is applying for 1 month extention on 15- july-2010.

My question is, since he has applied for extention can we stay in US after the expiration of I-94? and when can he get extention conformation?

Yes, He can stay/work 240 days after I-94 expiration, but he should apply for the H1 ext before I-94 exp.


-- This is my knowledge as per my case.
My H1/I-94 expired on June 11th 2010 and lawyer told me I can stay/work 240 days.
