Default I485 rfe

All,

I got an RFE about Employment Verification Letter and my situation is I moved from my GC sponsoring employer to a new employer back in Sep 2008. I was laid off and my last date with current employer is Aug 31, 2009. I will have to respond to my RFE by May 28 and want to take the letter from the current employer.

My only concern is as to how I should answer the last part of the query where they want the issuing authority to tell if the position is still open and all the conditions are satisfied as per the employment visa petition. With current layoff, I dont know if they will issue that statement in their letter.

Please suggest and help me get through this crisis.

Thanks alot

The position has to be "permanent". Once the layoff is announced, it doesnt matter whether you are employed currently or not, the position is going to be removed and it is not "permanent". Check with employer, whether there is another permanent position available for you beyond 8/31.

Or find another offer ASAP. You can still be employed with your current employer, but should have a "permanent position" available to you, either as an offer or current employment.

Thank you so much.

Its very tough to actually procure one in this market.

Can I get an offer letter from some desi consulting company for future employment and still mention that I am currently working for the current employer and still go with my processing.

The letter they want is from the intended permanent employer. If I get this letter from my future employer, will it serve the purpose. They also want the proffered position, wages and start date for this offer.

Please suggest.

Thanks alot
