Default EB3 to EB2 porting with same employer

Hi All,

I am planning to upgrade my case from EB3 to EB2 with the same employer.I have only about 2.5 years before joining the company and i hold only a bachelors degree. Now i have total 7 years of experience. I have couple of questions.

1) Can i upgrade my case from Eb3 to EB2 using the experience from the same employer.

2) If i managed to upgrade and if there is any issue with my New EB2 application will that affect my EB3 application as well.

3) In what stage can we expect issues when we upgrade from EB3 to EB2 ( PERM / I140 ?

Default On the same boat

I had 4.5 years exp with bachelors before I joined my current company as software engg.. I have total 12 years exp now and also have Senior Software Engineer to my title. I filed EB3 and have filed 485 pending for last 4 years.. just like thousands others.

I would like to port/ use priority date from EB3 (NOv 2003) to EB2. I would like to file fresh EB2 through the same employer. What are the requirements to do that? Is the initial EB3 case
in any jeopardy because of new job duties etc...

Is it possible? Please explain, share your experience as much as possible.

It is possible but the job responsibilities should be >50% different. There are several instances of porting from EB3 -> EB2 with same employer. It depends on how well you manage position description, ads etc. If mistakes are made, you will attract RFEs and encounter delays. Just need to handle with care.
