Talking PERM Audit- Denied because of missing PWD in audit reply

PD-07/06/2011
Audit date: 09/23/2011
Audit reply date :10/18/2011
Denied date: 02/27/2012

Denial reason: Employer failed to provide the prevailing wage determination( PWD) in response to Audit reply.
My attorney told me he did send PWD in my audit response. He has proof of all document that he sent for audit reply

According to denial letter, we can't file appeal or motion because of missing document. Letter clearly mentioned that we have to file new perm application.

It is very unfortunate because we have waited two months to get PWD and my attorney send that with my audit response.

What i can do in this situation?

If we have to file new PERM , Can we use same PWD and recruitment report so we don't need to waste 3 months and file new perm based on old information?

Default Audited PERM

Hi,

My PERM went into audit, asking for wage report, recruitment report. My employer have PWD and recruitment report. I have the following questions:

1. Do I respond to the audit, any idea how long it will take for a decision. What are the chances it is approved.
2. Can an other employer use the same PWD for filing my PERM. Please let me know
