IR1 spouse of a US citizen petitioner and applicant in India
My spouse had a 10 year bar due to overstay in the US long time ago.
The 10 year bar was over a few months back and my spouse went to the consulate for an interview for IV under IR1.
At the time of my spouse's IV the consulate raised the following points
1. Need to get a Joint Sponsor
2. The petitioner needs to have domiciled in the US
3. The applicant needs to get a new passport
My/petitioner's notes on each of the above points.
1. The petitioner is residing in India and does not have a job at the present time
2. The petitioner has been maintaining a bank account and has been filing US tax returns ever since leaving the US
3. The applicant or my spouse is holding a Indian passport valid for 20 years on her maiden name
Please throw some light on what is being asked by consulate and why?
