Default Expedite H4 visa processing

Hi All,

Recently I applied for change my status from F1 OPT to H4. It has been 2.5 months since I applied for COS and my case has not yet been processed at the Vermont Center. USCIS rep said that Vermont Center has backlogs from Aug 2014 and I will have to wait for another 6 -7 months for the visa. I am eligible for H4 EAD. I was hoping to apply for the EAD which will take atleast 90 days to process. So, I am looking at 9 months before I am even eligible for employment. I have a few employers who are ready to employ me, but they will not wait for another 10 months to hire me. Additionally, in Texas, when your OPT expires, your driving license expires. As of now, I can't even drive anywhere, which may look like a silly issue,but with no good public transport system, it is very difficult on a day-to-day basis.

A friend of mine suggested I contact the Congressman and ask for his help. Did anybody in the forum tried that and got help?

Has anybody faced such an issue with USCIS? Did you try to expedite your process?

I am not sure of how it works when you approach congressman, but one way is to go out of the county and get H4 visa stamped . I know it involves travel, money and bit of risk

I am aware of that solution. Since my application is still pending, I cannot travel outside the country.

You CAN TRAVEL out of the Country, while ur application is pending. In such a event, your COS application will be killed and the H4 stamping will take preceedence. This is our firsthand experience.

Default Question about OPT

Hi, This is Sagar. I have a question about OPT. My wife joined full time masters degree in Summer 2014 on H4. She applied for change of status to F1 on Oct 8th,2014 and got approved on Mar 6th, 2015. She just have 6 more credits (2 courses) to finish masters. I would like to know if she can enroll in summer 2015 and complete the program and still get OPT. I was reading blogs, some say she has to be on F1 for 2 full semesters(not including summer) and others say it's not required. One blog said If someone do masters on a valid visa which permits to study, they will get OPT. She was trying to find it out at her university through ISO(International service officer) but she didn't get much helpful information.
I would appreciate any response.

Hi Sagar,
To the best of my knowledge, one must be a full time student atleast for an year (2 regular semesters excluding summer) in order to qulaify for OPT. Atleast, this WAS the case, few years back. I am not sure, if the things have chnaged. I am not sure about the second option that you described. Each college has Designated School Official (DSO) that represents USCIS and provides clarifications on matters as these. Please, reach out to DSO and he/she will be able to help.
